The following terms, conditions and limitations of liability apply to and for the protection of On Point Systems,Inc.
its employees, service agents and independent subcontractors.It is agreed that the value of the shipment, regardless of the number of packages is not greater than $100.00 and hence the liability of On Point Systems,Inc. for damages or loss as regards such shipment is limited to $100.00.
Shipments of greater value must be declared at the time the order is placed with On Point Systems,Inc. in which case a suitable rate will be furnished by On Point Systems,Inc. to insure the higher value as declared by the client. Losses or damages due to improper packing, labeling, or caused by delay are not the liability of On Point Systems,Inc.
Further On Point Systems,Inc. is not responsible for high value items unless declared by the client at the time of placing the order. Claims must be submitted in writing to On Point Systems,Inc. within 48 hours of receipt of the shipment by On Point Systems,Inc. Claims not made within such forty-eight hour period shall be deemed waived by client.
The shipper agrees to hold On Point Systems,Inc. harmless against any claim in any amount in excess of the foregoing limits of liability should any such claim be made by a third party for loss or damage of merchandise handled by On Point Systems,Inc., irrespective of the cause of loss and damage including negligence.
